Terms of Service

> **Template Notice**: This draft Terms of Service should be reviewed by a Georgia-licensed attorney before publication. The Assumption of Risk and Release of Liability section (Section 5) is particularly important for martial arts operations and may require a separate executed waiver at enrollment.
These Terms of Service ("Terms") govern your use of the Kim's K Taekwondo website and your enrollment in our programs at our facility in Duluth, Georgia. By using our website or services, you agree to these Terms.
## 1. Acceptance
By using our website, enrolling in classes, or entering our facility, you ("you" or "Member") agree to these Terms and our Privacy Policy. If you are enrolling a minor, you represent that you are a parent or legal guardian with authority to consent on their behalf, and you accept these Terms on the minor's behalf as well.
## 2. Services
Kim's K Taekwondo offers:
- Taekwondo instruction for all ages and belt levels
- Special programs including summer camps, birthday parties, and demonstration team
- Tournament training and travel team (Team K)
- Belt testing and Kukkiwon certifications
Class availability, instructors, and schedule may change. We will give reasonable notice of material changes.
## 3. Enrollment, Tuition & Billing
- **Tuition** is billed monthly in advance through Stripe via auto-pay.
- **Auto-renewal**: Your enrollment continues each month until you cancel.
- **Failed payments**: We may suspend class access for past-due accounts and re-attempt collection. Past-due balances are subject to a reasonable late fee.
- **Cancellation**: You may cancel at any time through your Customer Portal or by contacting us. Cancellation is effective at the end of the current billing cycle. There are no partial refunds for unused days.
- **Refunds**: Tuition is generally non-refundable. We may, in our sole discretion, grant pro-rated refunds for documented medical reasons or extended absences with prior notice.
- **Fees not included in tuition**: belt testing fees, uniforms and equipment, tournament entry, special programs.
- **Returned payments**: A reasonable return-item fee may apply.
## 4. Code of Conduct
Members agree to:
- Show respect to instructors, fellow students, and the dojang
- Wear the appropriate uniform (dobok) and safety equipment
- Follow safety instructions and rules of the studio
- Refrain from disruptive, threatening, harassing, or unsafe behavior
- Not bring weapons, alcohol, illegal substances, or pets onto the premises (service animals excepted as required by the ADA)
- Not photograph or video other members without consent
Violation of this Code may result in suspension or immediate termination of membership without refund.
## 5. **Assumption of Risk and Release of Liability**
**THIS SECTION CONTAINS A WAIVER OF LEGAL RIGHTS. READ CAREFULLY BEFORE ENROLLING.**
Taekwondo and martial arts training involve **inherent risks of physical injury**, including but not limited to bruises, sprains, strains, fractures, dislocations, concussions, dental injuries, and rare but possible serious injury. By participating, you (and any minor for whom you are enrolling) acknowledge and **voluntarily assume these risks**.
To the fullest extent permitted by Georgia law, you hereby release, waive, and discharge **Kim's K Taekwondo, its owners, instructors, employees, contractors, and agents** from any and all claims, demands, and causes of action arising from or related to your participation, **except for claims arising from our gross negligence or willful misconduct**. You agree to indemnify and hold harmless the released parties from any claim brought by you or on your behalf arising from your conduct, including reasonable attorneys' fees.
This release is governed by Georgia law and is intended to be as broad as legally permitted. If any portion is held invalid, the remaining portions remain in force.
**A separate Liability Waiver, Medical Release, and Photo/Video Release form must be signed at enrollment.**
## 6. Health & Medical
- Members are responsible for disclosing health conditions that may affect safe participation.
- We are not medical professionals and do not diagnose or treat medical conditions.
- In a medical emergency, we may seek emergency medical care at the member's (or parent's) expense and will attempt to contact the emergency contact on file.
- Members with communicable conditions or illness must not attend class.
## 7. Photo and Video Release
By enrolling, you grant Kim's K Taekwondo a non-exclusive, royalty-free license to use photographs and video taken on our premises or at our events for promotional purposes (website, social media, advertising). You may **opt out in writing** to info@kimsktaekwondo.com; opt-outs apply prospectively and do not require removal of previously published materials.
## 8. Intellectual Property
The "Kim's K Taekwondo" name, logo, uniforms, curriculum materials, photographs, and website content are protected by trademark, copyright, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our prior written permission.
## 9. Website Use
You agree not to:
- Use the website for any unlawful purpose
- Attempt to gain unauthorized access to any portion of the website
- Interfere with site security or functionality
- Submit false, misleading, or harmful content
## 10. Disclaimers
Our services are provided "as is" and "as available." We make no warranties (express or implied) about specific outcomes, including but not limited to belt advancement, tournament placement, fitness improvements, or self-defense effectiveness.
## 11. Limitation of Liability
To the maximum extent permitted by Georgia law, in no event shall Kim's K Taekwondo's total aggregate liability arising from these Terms or your use of our services exceed the total tuition you have paid to us in the twelve (12) months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages.
## 12. Governing Law & Dispute Resolution
These Terms are governed by the laws of the **State of Georgia, U.S.A.**, without regard to its conflict-of-laws provisions.
Any dispute arising from these Terms or your use of our services shall be resolved **exclusively in the state or federal courts located in Gwinnett County, Georgia**, and you consent to personal jurisdiction and venue in those courts.
Before filing any legal action, you agree to first attempt good-faith resolution by contacting us at info@kimsktaekwondo.com. If we cannot resolve a dispute within 30 days, either party may proceed in court.
## 13. Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect, and the invalid provision shall be construed to the maximum extent permitted by law.
## 14. Entire Agreement
These Terms, together with our Privacy Policy and any executed enrollment or waiver forms, constitute the entire agreement between you and Kim's K Taekwondo regarding the subject matter.
## 15. Changes to These Terms
We may update these Terms from time to time by posting a revised version. Material changes will be communicated by email or notice on our website. Continued use of our services after such changes constitutes acceptance.
